Zu diesem Fahrzeug möchten wir Ihnen als Verkäufer Folgendes mitteilen:
Der Europäische Gerichtshof hat sich jüngst in mehreren Entscheidungen zu Abgasreinigungssystemen in Diesel-Fahrzeugen geäußert und die Anforderungen an deren Rechtfertigung wesentlich verschärft. Die Auslegung der regulatorischen Anforderungen an Emissionskontrollsysteme ist infolge der neuen Entscheidungen des Europäischen Gerichtshofs in Entwicklung begriffen. Dies zeigt sich unter anderem darin, dass die etablierte Verwaltungspraxis der Zulassungsbehörden von vielen Seiten hinterfragt wird.
Auch deshalb wird in der Öffentlichkeit weiterhin viel über Fahrzeugeigenschaften wie deren Emissionen und Kraftstoffverbräuche diskutiert. Dies betrifft insbesondere die Zulässigkeit bestimmter Softwarefunktionen in Motoren und Getrieben, deren Kalibrierung, die Ansteuerung von Teilen der Emissionskontrollsystemen sowie deren technische Notwendigkeit.
Zu den relevanten Emissionskontrollsystemen zählen unter anderem die Abgasrückführung (AGR), der NOx-Speicherkatalysator (NSC) und das SCR-System. Diese werden über Softwarefunktionen und in Abhängigkeit von diversen Parametern gesteuert. Zu diesen Parametern können verschiedene Betriebsbedingungen gehören, wie z.B. Temperaturen, Luftdrücke, bestimmte Motorzustände, Kraftstoffeinspritzmengen, Klimaanlagenzustände sowie Parameter, die im Zusammenhang mit bestimmten Fahrsituationen stehen. Beispiele hierfür sind Geschwindigkeit, Fahrtdauer, Lenksituation, Leerlauf und ähnliches. Dies gilt auch für Betriebszustände des Getriebes wie etwa ein Leerlauf oder die Nutzung verschiedener Schaltkennlinien.
Wir machen Sie darauf aufmerksam, dass die beschriebene Diskussion auch für das oben genannte Fahrzeug relevant ist.
Insgesamt kann nicht mit Sicherheit vorhergesagt werden, wie Behörden und/oder Gerichte in diesem Zusammenhang technische und rechtliche Fragestellungen im Einzelfall bewerten werden. Es kann daher auch nicht ausgeschlossen werden, dass einzelne Fahrzeugeigenschaften (insbesondere Softwarefunktionalitäten) von Behörden und/oder Gerichten, aus den oben genannten oder anderen Gründen bemängelt werden oder als unzulässig bewertet werden könnten. Behörden und/oder Gerichte könnten dabei etwa auch zu dem Schluss kommen, dass sie Emissions- und/oder Verbrauchsangaben bzw. CO2-Werte abweichend bewerten.
Die BMW Group als Hersteller des Fahrzeugs wird sich in diesem Fall selbstverständlich um die Aufrechterhaltung oder Wiederherstellung der Zulässigkeit bemühen. Obwohl es bisher zu keinem solchen Fall bei der BMW Group gekommen ist, kann nicht mit Sicherheit ausgeschlossen werden, dass Behörden Maßnahmen gegen Fahrzeughalter anordnen, und/oder ein Entzug der Fahrzeugzulassung und/oder eine Nutzungsuntersagung drohen könnte. Auch wenn sich die BMW Group bemühen wird, dies zu verhindern, können aus solchen Maßnahmen folgende Auswirkungen auf den Wiederverkaufswert der Fahrzeuge ebenfalls nicht mit Sicherheit ausgeschlossen werden.
Um Nachteile für Sie im größtmöglichen Maße zu vermeiden, kann es aus den zuvor genannten Gründen zur Bereitstellung von Lösungen (z.B. Software-Updates) für dieses Fahrzeug kommen. In diesem Fall werden Sie unaufgefordert informiert und die Maßnahmen an Ihrem Fahrzeug voraussichtlich in einer Serviceaktion umgesetzt werden. Eine derartige Maßnahme wäre für Sie selbstverständlich kostenlos.
Ergänzend möchten wir feststellen, dass die Fahrsicherheit durch keinen der o.g. Sachverhalte beeinträchtigt ist.
Durch Ihr Gebot bestätigen Sie, dass:
1. Ihnen die vorgenannten Umstände durch den Verkäufer mitgeteilt worden sind,
2. Sie dieses Fahrzeug in Kenntnis des oben beschriebenen Sachverhaltes kaufen und/oder übernehmen und
3. Sie mit der Durchführung einer etwaigen [für Sie natürlich kostenlosen] Maßnahme am oben genannten Fahrzeug einverstanden sind, sollte diese bereitgestellt werden.
