Customer information on vehicle conformity As you are a seller, we would like to inform you of the following information about this vehicle: The European Court of Justice has recently given its opinion in several decisions regarding pollutant emission control systems in diesel vehicles and has considerably tightened the requirements for their justification. The interpretation of the regulatory requirements for emission control systems is being developed as a result of the new decisions by the European Court of Justice. The latter is evident among other things by the fact that the established administrative practice of the licencing bodies is being challenged on many fronts. This is one of the reasons that there continues to be lots of public discussion about vehicle features such as their emissions and fuel consumption. It affects in particular the permissibility of certain software functions in engines and gearboxes, their calibration, the control of parts of the emission control systems as well as their necessity from a technical perspective. The relevant emission control systems include among other things the exhaust gas recirculation (EGR), the NOx storage catalytic convertor (NSC) and the Selective Catalytic Reduction (SCR) system. They are controlled via software functions and depend on several parameters. These parameters can include various operating conditions such as temperature, air pressure, certain engine conditions, fuel injection volume, air conditioning levels together with parameters, which are associated with certain driving situations. Examples for this are speed, journey time, steering situation, idling and the like. This also applies to operating states of the gearbox such as idling or the use of various shifting characteristics. We would like to make you aware that the discussion described is also relevant for the above-mentioned vehicle. Overall, it cannot be forecast with certainty how authorities and/or the courts will assess technical and legal issues on this subject in an individual case. It therefore cannot be ruled out that individual vehicle features (in particular software functionalities) might be criticised or assessed as inadmissible by authorities and/or the courts for the above-mentioned or other reasons. The authorities and/or the courts could therefore also reach the conclusion that they will assess the emissions and/or consumption details regarding CO2 values differently. In this case, the BMW Group, as the vehicle manufacturer, will of course make every effort to maintain or recreate the admissibility. Although no such case has affected the BMW Group so far, it cannot be ruled out with any certainty that authorities might order measures against vehicle keepers, and/or withdraw the vehicle registration and/or might threaten a prohibition on use. Even if the BMW Group makes every effort to prevent this, the following effects on the resale value of the vehicle resulting from such measures can also not be ruled out with certainty. In order to prevent any disadvantages to you as far as possible, solutions ( e.g. software updates) might be provided for this vehicle for the reasons mentioned previously. In this case, you will be informed automatically and the measures required for your vehicle will probably be undertaken when your vehicle is serviced. Naturally, there would be no cost to you for such a measure. We would like to state additionally that there is no adverse effect on driving safety owing to the above-mentioned facts. By placing your bid, you confirm that: 1. You have been informed of the above-mentioned circumstances by the seller, 2. You are buying and/or taking over the vehicle with the knowledge of the facts described above and 3.
