Customer Information – Vehicle Conformity As the seller, we want to make you aware of the following: In multiple decisions, the European Court of Justice has recently commented on exhaust gas cleaning systems in diesel vehicles and significantly tightened the requirements that warrant their use. The interpretation of the regulatory requirements for emission control systems is in a state of flux as a result of the European Court of Justice’s decisions. Among other things, this is reflected in the established administrative practice adopted by the vehicle licensing agencies being called into question by numerous parties. This is also the reason for the general public continuing to engage in an ongoing debate on vehicle features such as their emissions and fuel consumption. In particular, this concerns the legitimacy of certain software functions in motors and transmissions, their calibration, the control of parts of the emission control systems, and also their technological need. The emission control systems concerned include exhaust gas recirculation (EGR), lean NOx traps (LNT) and SCR systems. These are software-controlled and dependent on certain parameters. Various operating conditions fall under these parameters, including temperature, air pressure, certain engine conditions, fuel injection rate, climate control system conditions as well as parameters related to certain driving situations. Examples of this include speed, journey time, driving period, idling and similar. This equally pertains to the operating conditions of transmissions, such as idling or the use of various shifting characteristics. Please note that the above discussion also applies to the aforementioned vehicle. All things considered, it is not possible to predict for certain how agencies and/or courts will assess the technical and legal issues in particular cases. It therefore cannot be excluded that individual vehicle features (in particular software functionalities) might be criticised by agencies and/or courts for the aforementioned or other reasons, or deemed to be illegal. At the same time, agencies and/or courts might come to a different conclusion as to the rating of emissions and/or fuel consumption data or CO2 emissions data, for example. As the vehicle manufacturer, BMW Group will, of course, make every effort to uphold their legitimacy in such instances or have them reinstated. Whilst BMW Group has yet to encounter any such cases, it cannot be excluded with certainty that agencies might impose measures on vehicle keepers and/or revoke the vehicle registration and/or threaten to prohibit the use of the vehicle. Although BMW Group will make every effort to prevent this, the following impact on the resale value of vehicles cannot be excluded with certainty as a result of the above measures. To give you the greatest possible protection from incurring such disadvantages, solutions (e.g. software updates) may be provided at times for the aforementioned reasons. In this case, you will receive an automatic notification and the intervention will most likely be carried out on your vehicle as part of a service action. Needless to say, the intervention would occur at no cost whatsoever to you. As a complementary measure, we would like to establish that the safe driving of the vehicle is not compromised by the above-mentioned facts. By submitting your bid, you hereby confirm that: 1. you have been informed by the seller of the aforementioned circumstances; 2. you are purchasing and/or taking possession of this vehicle in full knowledge of the facts outlined above; and 3. you agree to any interventions being carried out [at no cost to you, of course] on the aforementioned vehicle where these may be provided.
